KittenSoft Instant Win Terms and Conditions

Conditions of Entry: Please read these conditions carefully. These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this Promotion all participants will be deemed to have read, understood and accepted these terms and conditions and be bound by them. Please retain a copy for your information.

1. The Promoter: Sofidel Ireland Ltd 38 Upper Mount street, Dublin 2, Ireland.

2. Who can enter: You can enter this Promotion if you are an ROI resident, aged 18 or over. Entry is not open to: (i) Employees of the Promoter or their immediate families; or (ii) anyone else professionally connected with the planning or administration of this Promotion. The Promoter may require, and you agree to provide, any information that it considers reasonably necessary, such as proof of purchase, in order to verify your eligibility.

3. There are 100s of prizes to be won during the promotion, including 300 Soft Toys, 300 Trolley Tokens and a grand prize draw of a €2,000 Sunway Holiday voucher.

4. Prizes are as stated and no cash alternatives are available, except that in the event of circumstances outside of its control the Promoter reserves the right to substitute similar alternatives of equal or greater value. 

5. How to enter: To enter: (i) purchase a pack of KittenSoft; (ii) scan the QR on the back of the pack; enter your details at https://kittensoft.com/, correctly answer a simple test of skill; then follow the on-screen prompts and use your smartphone camera to scan the image of the kittens on the back and find out if you’ve won an instant prize. All entries, regardless of whether they win an instant prize, will be entered into the grand prize draw on Dec 22, 2023). Entries are limited per one entry per week per mobile number. 

6. Entrants must complete all of the steps and scan the kittens on the pack and complete the instant win prize draw to be entered into the main prize draw. Internet access via a Smartphone (only) is required for entry. Winners will be required to enter their name, address, date of birth and email address and mobile number to claim their prize and or enter the main prize draw. Winners will be notified immediately for Instant Win prizes and no later than Monday 8th January 2024 for the grand prize draw. Winners of Instant Win prizes must follow the on-screen prompts to claim their prize. Winners must claim their prizes within 5 working days and failure to do so may result in the prize not being awarded. Winners will be contacted via the mobile number they provide upon entry. Winners may also be required to submit proof of purchase in the form of receipt.

7. Smartphone requirements: This promotion only works on a Smartphone. In order to enter the promotion, you must have a smartphone with a camera capable of scanning QR codes and running the latest versions of Chrome or Safari installed supporting WebGL and native Web-AR. iOS users must have iOS 11 or later installed and internet access to enter. Please check with Google or Apple support if you are unsure as to whether your handset is compatible for this promotion.

The Promoter cannot accept responsibility for entries lost or delayed, or for technical, database or network error or for any associated costs to claimants.

9. Purchase is required. You must retain receipt(s) and packaging as proof of purchase. 

10. One purchase of a pack of KittenSoft = one single entry into the Promotion. Entries are limited per one entry per week per mobile number. 

11. Promotion details: The promotion will run from 14th September 2023 to 21 December 2023 with the grand prize draw taking place on 22 December 2023.

12. Winners of Instant Win prizes will be randomly selected from the complete, valid and eligible entries received during the entry period using computer-generated algorithm generated prize draw logic. Winners of the instant win prize draw experience will be notified instantly and must follow the on-screen instructions to claim their prize instantly to enter using the mobile number that was used to enter the prize draw initially. The Promoter will make reasonable efforts to contact the winners. However, if a winner of the instant win prizes has not claimed their prize immediately, we reserve the right to re-allocate their prize into the prize pool. 

13. The winner of the Grand Prize will be randomly selected from the complete, valid and eligible entries received during the total entry period using a computer-generated draw. Entries are limited per one entry per week per mobile number. 

14. Winners will be notified by email within 7 working days of being drawn, using the contact details provided on entry. The Promoter will make reasonable efforts to contact the winner. However, if a winner has not responded to notification within 14 days, or if a selected winner is ineligible, in breach of these rules, or unable to take up the prize for any other reason, an alternative winner will be drawn using the same methodology as above. The process will repeat until an eligible winner is able to claim the prize. Entrants should monitor their connections during this time in case they are the winner.  

15. Mop Up Prize Draw: There will be a mop up draw for any unclaimed prizes no later than 14 days from the final date of the promotion ending. All of the entrants who successfully enter the main prize draw will be added to the mop up prize draw. 

16. If you win, you may not sell, auction or otherwise transfer your prize for payment to anyone else or attempt to do so, unless the Promoter agrees otherwise.

17. The Promoter may, at its sole discretion, carry out verification checks on winners to ensure they have not breached these conditions. Please note that, if you win, it may take up to 28 days from the date of a valid claim for the Promoter to send your prize. 

18. The Promoter may, at its sole discretion, opt to re-award your prize to a reserve winner selected on the same basis as you in any of the following circumstances: (i) if you win a prize and you do not claim it by sending your contact details via our promotional website within the timeframes set out at clause 12 above; (ii) if you win any prize and fail our verification or eligibility check; (iii) if you win any prize and are disqualified for any reason; or (iv) if you win any prize and you are unable to accept it for any reason. 

19. The Promoter reserves the right to verify all entries including but not limited to asking for address, identity details, receipts (which you agree to provide within 14 days) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the Promotion and disqualify the participant where there are grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this Promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the Promotion or won using fraudulent means. The Promoter will be the final arbiter in any decisions, and these will be binding in all respects and on all entrants and no correspondence will be entered into in relation to this clause.

20. No third party or bulk entries. If it becomes apparent that any entrant or third party is using any means to circumvent these terms or acting fraudulently or dishonestly in the opinion of the Promoter or otherwise acting in violation of the terms, then these entrants will be disqualified, and any prize entitlement will be void. We will not enter into any discussion in this regard and the promoter’s decision is final. 

21. The Promoter reserves the right to cancel or amend the Promotion and/or vary these conditions in the event of circumstances outside of its reasonable control, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this Promotion or the awarding of prizes. The Promoter will make reasonable efforts to minimise the effect to participants in order to avoid undue disappointment.

22. To the fullest extent allowed by law, the Promoter will not be liable to you in respect of your inability to enter due to issues accessing the promotional website and the Promoter does not accept responsibility for network, computer, hardware or software failure of any kind, which may affect the sending, receipt or processing of entries.

23. The winner may be requested, and agrees, to take part in unpaid media activity relating to the competition. The promoter is entitled (but not obliged) to use the winner’s name and image in connection with such publicity.

24. Details of the winners’ name and county may appear on our promotional website and on KittenSoft social media channels. For a full list of all winners, please send details by email of your request with subject line ‘KittenSoft Instant Win Promotion’ to info@kittensoft.com within three months of the applicable closing date. 

25. To the fullest extent permitted by law and excluding death or permanent injury caused as a result of the Promoter’s negligence, the Promoter accepts no liability for loss or injury as a result of the Promotion or receipt or misuse of any prize.

26. The application and interpretation of the terms and conditions shall be governed by the laws of the Republic of Ireland and the courts of the Republic of Ireland will have exclusive jurisdiction in respect of any dispute.

27. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless it has your consent. The entrant’s personal details will at all times be kept confidential and in accordance with current Data Protection legislation.
